EXPLANATION OF APPEAL HEARING PROCESS

 

 

T. Caterina explained the appeal hearing process and asked if anyone objected to any Member of the Community Standards Licence Appeal Committee hearing the appeals. No one objected.

COMMUNITY STANDARDS AND LICENCE APPEAL COMMITTEE MATTERS

3.1

Appeal of Order – R. R., 301 Grand Meadow Crescent NW, Order pursuant to Section 546(1)(c) of the Municipal Government Act.

 

 

             Requests to speak were received from M. K. and G. V.

R. R., Appellant, made a presentation and answered the Committee’s questions. Copies of his presentation were provided to the Respondent, members of the Committee, and the Office of the City Clerk.

C. Ashmore, Law Branch, answered the committee’s questions.

T. Courtoreille, Community Services Department, made a presentation and answered the committee’s questions. Three sets of photographs dated July 23, 2012, Sept. 10, 2012, and October 15, 2012, were provided to the Appellant, members of the Committee, and the Office of the City Clerk.

M. K. and G. V. made presentations in support of the Respondent’s position.

The Committee met in private at 10:20 am, pursuant to Section 20 of The Freedom of Information and Protection of Privacy Act.

The Committee met in public at 10:29 am.

You are therefore ordered to remove all tires, furniture, wood, plastics, metals, shelving, pipes, satellite dishes, derelict vehicles whether licensed and insured or not, bicycles, loose litter and debris and other assorted materials from the entire property and take any actions or remove any other items that are contributing to the unsightly condition of the property

T. Caterina asked the Appellant if she objected to any member of the Community Standards and Licence Appeal Committee hearing the appeal. There was no objection.

C. S., Appellant, made a presentation and answered the Committee's questions. Copies of her presentation were provided to the Respondent, members of the Committee, and the Office of the City Clerk.

D. M., interested party, made a presentation in support of the Appellant.

K. Scott, Coordinator, Community Standards Peace Officer Section, made a presentation and answered the Committee's questions.

C. Ashmore, Law Branch, answered the committee's questions.

The Committee met in private at 11:10 a.m., pursuant to Section 20 of The Freedom of Information and Protection of Privacy Act.

G. W., Appellant, made a presentation and answered the Committee's questions. Copies of his presentation were provided to the Respondent, members of the Committee, and the Office of the City Clerk.

L. W. made a presentation in support of the Appellant’s position and answered the Committee's questions. A copy of her presentation was made for the Office of the City Clerk.

T. Courtoreille, Community Services Department, made a presentation and answered the Committee's questions. He confirmed that Community Services Department would be willing to work with Mr. W. to assist him in achieving compliance with the Order.

Two sets of photographs dated Sept 4, 2012, and October 15, 2012, were provided to the Appellant, members of the Committee and the Office of the City Clerk

The Committee varies the order

You are therefore ordered to remove all scrap wood, old windows, doors, plywood, all loose litter and debris and other assorted materials from the entire property and take any actions or remove any other items that are contributing to the unsightly condition of the property by January 31, 2013.

And thereafter maintain the property to prevent the reoccurrence of any unsightly condition detrimental to the surrounding area.

B. R. M. chose not to address Item 3.3 but requested clarification as to why Appellants’ full names are withheld from the public. C. Cameron, Law Branch, advised that provincial legislation prohibits the City from releasing this information.
