EXPLANATION OF APPEAL HEARING PROCESS

 

 

Councillor Diotte explained the appeal hearing process and asked if anyone objected to any Member of the Community Standards Licence Appeal Committee hearing the appeals. No one objected.

S. McDonald, Office of the City Clerk, advised that a postponement request had been received and answered the Committee’s questions.

C. Ashmore, Corporate Services Dept. (Law) made a presentation and answered the Committee’s questions.

Appeal of Order – E.P., 11448 - 92 Street NW, Edmonton, Alberta, Order Pursuant to Section 546(1)(c) of the Municipal Government Act

 

 

 

S. McDonald, Office of the City Clerk, advised the Committee that pursuant to an inspection conducted on the property, Administration has withdrawn the Order against this property because the property is now in compliance with the Community Standards Bylaw 14600.

The Appellant, E.P., was in attendance as he was not aware of the withdrawal. Ryan Pleckaitis, Community Services Dept., Sheila McDonald, Office of the City Clerk and Cameron Ashmore, Corporate Services Dept. (Law) met with the appellant in private at 9:52 a.m. The meeting reconvened at 9:58 a.m.

Appeal of Order – G.L.O., 15810 - 50 Street NW, Edmonton, Alberta, Order Pursuant to Section 545(1) of the Municipal Government Act.

That the Appeal hearing for G.L.O., 15810 - 50 Street NW, Edmonton – Order Pursuant to Section 545(1) of the Municipal Government Act, be postponed to the first Community Standards and Licence Appeal Committee meeting scheduled in 2012.

Appeal of Order – J.N. / W.N., 9548 - 63 Avenue NW, Edmonton, Alberta, Order Pursuant to Section 546(1)(c) of the Municipal Government Act.

 

 

 

W.N., Appellant, was not present.

R. Pleckaitis, Community Services Dept., made a presentation and answered the Committee's questions.

Cameron Ashmore, Corporate Services Dept. (Law) answered the Committee's questions.

Two sets of photographs were provided to members of the Committee and the Office of the City Clerk.

The Committee upholds the order after reading a letter from the Appellant who was not in attendance and reviewing the photographs of the property.

You are therefore ordered to:

Remove all rags, clothing, furniture, chairs, tables, plastic containers and contents, televisions, wood, pipe, and all other debris and loose litter from the entire property. For greater certainty this would include all materials that are tarped or untarped. And take any action or measures necessary to remedy the unsightly condition.

Appeal of Order – Hromada Housing Co-Operative Limited, 10415 - 86 Avenue NW, Edmonton, Alberta, Order Pursuant to Section 545(1) of the Municipal Government Act.

 

 

 

Sheila McDonald, Office of the City Clerk, advised the order issued to Hromoda Housing Co-operative Limited pursuant to Section 545(1) has been withdrawn by Administration after new information was brought forward.

R. Pleckaitis, Community Services Dept., confirmed the withdrawal, gave background information and answered the Committee's questions.

 A set of photographs was provided to the Committee and the Office of the City Clerk. 

 

3.6

Appeal of Order – J.B.A., 11543 - 94 Street NW, Edmonton, Alberta, Order Pursuant to Section 546(1) of the Municipal Government Act.

 

 

 

T.W., from the Senior’s Association of Greater Edmonton (SAGE), representing J.B.A., Appellant, made a presentation and answered the Committee’s questions.

Mike Martin, Community Services Dept., made a presentation and answered the Committee's questions.

Two sets of photographs were provided to the Appellant, Members of the Committee and the Office of the City Clerk.

The Committee varies the order.

You are therefore ordered to:

With the assistance of SAGE, remove all ladders, coolers, plastic containers, plastic, shovels, plastic carts, blankets, extension cords, wood, panels, furniture, dog kennels, cardboard, bricks, fencing materials, walkers, automotive parts, bikes, jerry cans, lawn mowers, cribs, bicycles, grass cutting equipment, bottles/cans, strollers, siding, derelict/damaged/dismantled vehicles, mops, furniture, bed frames, steel, metal, carpet, clothing, propane tanks, pails, appliances and tools.

Remove all debris and loose litter from the entire property and take any action or measures necessary to remedy the unsightly condition by October 31, 2011 and thereafter maintain the property to prevent reoccurrence of the unsightly and untidy condition.
