That Transportation Committee recommend to City Council, in its capacity as the Expropriating Authority under the Expropriation Act: 1. That the commencement of the expropriation process to acquire the fee simple portion of property labelled as “Fee Simple” on Attachment 1 and legally described in Attachment 2 of the February 4, 2015, Transportation Services report CR_2028, including all interests therein, be approved. 2. That the commencement of the expropriation process to acquire a temporary construction easement in the portion of property labelled as “Construction Easement” on Attachment 1 and legally described in Attachment 3 of the February 4, 2015, Transportation Services report CR_2028, be approved. 3. That the commencement of the expropriation process to acquire a permanent access easement in the portion of the property labelled as “Access Easement” on Attachment 1 and legally described in Attachment 4 of the February 4, 2015, Transportation Services report CR_2028, be approved. 4. That Administration be authorized to enter into agreements pursuant to Section 30 of the Expropriation Act (“Section 30 Agreement”) with the owner or owners of the property or parties who hold an interest in the property described in Attachments 2, 3 and 4 of the February 4, 2015, Transportation Services report CR_2028, when the owner or interest holder is willing to consent to the expropriation by the City. |
