That Bylaw 15776 be amended as follows:

1. Section 7.1 (d), Schedule B, be amended to delete the words “shall investigate the opportunity for the incorporation of” and replace with “shall incorporate a”

2. Section 7.1, Schedule B, be amended to delete s. 7.1 (b), and replace with:

7.1 (b) The owners(s) shall design and construct a publicly accessible viewpoint and trail connection that is to be located on the west side of the accessory quasi public park development located in Area B , extending across the public property and reconnecting at southwest corner of Area E. From this point along the south property line of Area E a pedestrian connection 1.85 m in width shall be located in general accordance with Appendix VIII. The publicly accessible viewpoint, the trail connection and the pedestrian connection shall be developed as follows:

· The publicly accessible viewpoint and trail connection shall be developed at the time that Area C is developed. The pedestrian connection adjacent to Area D shall be developed at the time Area D is developed. The pedestrian connection through Area E shall be developed at the time Area E is developed. The developer(s) shall register a public access easement for the portion of pedestrian connection that is located within Area B and E. The developer(s) shall register a public easement for the portion of trail connection that is located between Areas C and D to ensure public access to the trail connection located to the west of Areas B, C and D.

· Prior to the issuance of Development Permit for the associated development phase, the owners shall enter into an agreement (s) with the City of Edmonton for the detailed development and construction of the view point and trail connection. The agreement process includes detailed design reveiew and approval process which shall be in accordance with applicable City Standards and to the satisfaction of the Development Officer in consultation with AMPW – Parks. Details to be addressed in the Agreement and provided within the detailed design include but are not limited to asphalt pathways, viewing platform, additional plantings and benches and /or other seating.

3. Section 4.4 a., Schedule B, be amended to add “or pedestrian connection” after “multi-use trail” and to delete “where feasible.”

4. Appendix V delete and replace with an amended Appendix V, which adds a pedestrian connection adjacent to Area D and within Area E.

5. Appendix VII delete and replace with an amended Appendix VII, which adds a pedestrian connection adjacent to Area D and within Area E.

6. Appendix VIII delete and replace with an amended Appendix VIII, which adds a pedestrian connection adjacent to Area D and within Area E.
