EXPLANATION OF APPEAL HEARING PROCESS

 

 

T. Caterina explained the appeal hearing process and asked if anyone objected to any Member of the Community Standards Licence Appeal Committee hearing the appeals. No one objected.

COMMUNITY STANDARDS AND LICENCE APPEAL COMMITTEE MATTERS

3.1

Appeal of order - J.S. 357 Hudson Bend NW, order pursuant to Section 545(1) of the Municipal Government Act.

 

 

 

J. S., Appellant, was not present.

M. Martin, Community Services Department, made a presentation and M. Martin and R. Pleckaitis, Community Standards  and Licence Appeal Committee Services Department, answered the Committee's questions.

Two sets of photographs, dated March 6, 2012 and April 30, 2012, were provided to the members of the committee.

The Committee upholds the order:

You are therefore ordered to:

Remove all furniture, appliances, wood, barrels, metal, pipe, carpet, rubber, plastic, tanks, tires, auto parts, wire, mattresses, cardboard, and all other debris and loose litter from the entire property and take any action or measures necessary to remedy the unsightly condition.

 

For greater certainty this would include all materials that are tarped or untarped.

Appeal of order - T. S. P. and K. K. P. 6304 - 17 Avenue NW, order pursuant to section 546(1)(c) of the Municipal Government Act.

 

 

 

S. McDonald, Office of the City Clerk, advised the Committee that pursuant to an inspection conducted on the property, Administration has withdrawn the Order against this property because the property is now in compliance with the Community Standards Bylaw 14600.

 

3.3

Appeal of order - C. T. and Tenant/Occupant, 9645 - 155 Street NW, order pursuant to section 545(1) of the Municipal Government Act.

 

 

             A request to speak was received from L. A..

That the committee hear from L. A. on behalf of the appellant.

L. A. made a presentation on behalf of the Appellant and answered the Committee’s questions.

A fax submission received from B. J. L., on behalf of the appellant, was distributed to the committee members, City Administration, Mr. Arnold, and C. Ashmore, Law Branch.

M. Martin, Community Services Department, made a presentation and M. Martin and R. Pleckaitis answered the Committee's questions.

Two sets of photographs, dated March 13,, 2012 and April 30, 2012, were provided to Members of the Committee.

The committee requested that administration attempt to arrange assistance to the elderly occupant in carrying out the order.

You are therefore ordered to:

Remove all damaged, dismantled or derelict vehicles or motor vehicles, whether insured or registered or not from the entire property. And take any action or measures necessary to remedy the unsightly conditions.

All vehicles on property must be removed.

Appeal of order - M. E. E. and D. R. E., 13808 - 110A Avenue NW, order pursuant to section 546(1)(c) of the Municipal Government Act

 

 

 

D. R. E., Appellant, made a presentation and answered the Committee’s questions.

M. Martin, Community Services Department, made a presentation and M. Martin and R. Pleckaitis answered the Committee's questions.

Two sets of photographs, dated April 16 2012 and April 30 2012, were provided to the Appellant, Members of the Committee and the Office of the City Clerk.

C. Ashmore, Law Branch, answered the committee’s questions.

The Committee varies  the order

You are therefore ordered to:

Remove all, wood/lumber/plywood, tires, rims, metal, pipe, plastic, concrete pieces/blocks, doors, wire, plastic/metal buckets, propane tanks, garbage cans, tree clippings, all items/materials on shelving units, cardboard, and all other loose litter and debris from the entire property.

Also take any and all actions or measures necessary to remedy the unsightly condition.

Property owner must comply with the Order by June 30, 2012.
