EXPLANATION OF APPEAL HEARING PROCESS

 

 

Councillor K. Diotte explained the appeal hearing process and asked if anyone objected to any member of the Community Standards Licence Appeal Committee hearing the appeals. No one objected.

Appeal of Order – R. R., 301 Grand Meadow Crescent NW, Order pursuant to Section 546(1)(c) of the Municipal Government Act.

 

 

 

The Committee agreed to hear Item 3.5 first as a written postponement request had been received from the Appellant who was not present.

Requests to speak were received from M.K. and G.V.

Two sets of photographs dated June 12, 2012, and September 10, 2012, were provided to the members of the Committee and the Office of the City Clerk..

Remove all furniture, dressers, televisions, wood, boards, lumber, plastics, wire, metal, auto parts, tires, boxes, cardboard, containers, pails, and all loose litter and debris and other assorted materials from the entire property and take any actions or remove any other items that are contributing to the unsightly condition of the property.

Appeal of Order – L. M. A., 13308 - 138 Street NW, Order pursuant to Section 545(1) of the Municipal Government Act.

 

 

 

Councillor K. Diotte explained the appeal hearing process and asked if anyone objected to any member of the Community Standards Licence Appeal Committee hearing the appeals. No one objected.

L. A., Appellant, made a presentation and answered the Committee’s questions.

T. Courtoreille, Community Services Department, made a presentation and answered the Committee’s questions.

Two sets of photographs dated July 10, 2012, and September 10, 2012, were provided to the members of the Committee and the Office of the City Clerk.

C. Ashmore advised that reference to Section 6 of the Community Standards Bylaw was missing from the original Order.

The Committee varies the Order as follows:

·         Reference to Section 6 of the Community Standards Bylaw 14600 to be included.

You are therefore ordered to:

Remove all wood, buckets, damaged/dismantled/derelict motor vehicles, insured or uninsured, registered or unregistered, (or put the missing tire back on the vehicle and fill all other tires with air) and all other debris and loose litter from the entire property and take any action or measures necessary to remedy the unsightly condition.

For greater certainty this would include all materials that are tarped or untarped..

Appeal of Order – K. G., 8915 - 80 Avenue NW, Order pursuant to Section 545(1) of the Municipal Government Act.

 

 

 

K. G. provided 3 sets of photographs to the Office of the City Clerk showing progress to date, made a presentation and answered the Committee’s questions.

T. Courtoreille, Community Services Department, made a presentation and answered the Committee’s questions.

C. Ashmore, Law Branch, advised that the Original Order was missing reference to Section 6 of the Community Standards Bylaw and the municipal address had a typographical error in it.

The Committee varies the order as follows:

·         Reference to Section 6 of the Community Standards Bylaw 14600 to be included.

·         Municipal address referred to in the Order be corrected to 8915 – 80 Ave.

You are therefore ordered to:

Repair all damage to the building and replace all rotten, deteriorated or missing roof components. Prevent any inappropriate infiltration of air, moisture or water by covering any holes or openings in the building and repairing and refinishing exterior surfaces that are unpainted, untreated or peeling.

This order must be complied with by October 31, 2012.

Appeal of Order – J. and N. C. 11718 - 129 Avenue NW, Order pursuant to Section 545(1) of the Municipal Government Act.

 

 

 

D. Beaudry, Office of the City Clerk, advised the Committee that pursuant to an inspection conducted on the property, Administration has withdrawn the Order against this property because the property is now in compliance with the Community Standards Bylaw 14600.

 

3.6

Appeal of Order – R. B., 9603 – 86 Street NW, Order pursuant to Section 545(1) of the Municipal Government Act.

 

 

 

R. B., Appellant, made a presentation and answered the committee’s questions. He requested a written copy of the Community Standards Bylaw 14600 which was provided to him by C. Ashmore, Law Branch.

The Committee recessed at 10:48 a.m. to allow R. B. time to review the Bylaw.

The Committee reconvened at 10:52 a.m.

T. Courtoreille, Community Services Department, made a presentation and answered the Committee’s questions.

Two sets of photographs dated July 24, 2012, and September 10, 2012, were provided to the Members of the Committee and the Office of the City Clerk.

The Committee varies the order with a revised due date.

You are therefore ordered to:

Remove all metal, wood, plastic, brick, loose litter and debris from the entire property, and take any action or measures necessary to remedy the unsightly condition.
